Dating Service Consumer Bill of Rights — New York members

This page is provided with every purchase and renewal of Eventide Premium by a New York member, as New York General Business Law §394-c(7)(e) requires, together with the notice of cancellation §394-c(7)(d) requires. The numbered text is the statute's own; the notes in italics say how each item applies to Eventide. The page must be linked, conspicuously and by that name, from the purchase screen and from the Terms of Service.

YOU, THE BUYER, MAY CANCEL THIS CONTRACT WITHOUT ANY CANCELLATION FEE WITHIN THREE (3) BUSINESS DAYS AFTER THE DATE OF THIS CONTRACT. SEE THE NOTICE OF CANCELLATION BELOW FOR AN EXPLANATION OF THIS RIGHT.

Dating Service Consumer Bill of Rights

  1. No social referral service contract shall require the payment by you, the purchaser, of an amount greater than one thousand dollars. In addition, no such contract may extend over a period of time greater than two years. Eventide Premium is sold in one-, three- and six-month terms at the prices shown in the app; no term exceeds one year and no price approaches this limit.

  2. No social referral service contract shall require you, the purchaser, to purchase a good or service which is directly or indirectly related to the social referral service. These extra services are known as ancillary services and, while these ancillary services may be offered to you, the law prohibits the seller from requiring that you purchase this service as a condition of your social referral service contract. Eventide sells nothing but Premium, and Premium is optional: the free service includes a full profile, daily introductions, likes, matching and messaging.

  3. If your social referral service contract costs more than twenty-five dollars, the seller must furnish a minimum number of referrals per month to you, unless your social referral service provides the user with a search functionality or is presented with possible matches. If this minimum amount is not furnished to you for two successive months, or in the case of an online dating service with search functionality or algorithm or location based matching, any social referral, you have the option of cancelling the contract and receiving a full refund of all the money you paid, less a cancellation fee which cannot exceed either fifteen percent of the cash price or a pro rata amount for the number of referrals furnished to you. Eventide presents you with possible matches every day. If, for two successive months, you are presented with no introductions at all, you may cancel and be refunded everything you paid. We charge no cancellation fee of any kind, so the fifteen-percent and pro-rata limits above never apply.

  4. Unless your social referral service contract is for online dating services that are generally available to users on a regional, national or global basis, your social referral service contract must specify the distance which you, the purchaser, are willing to travel to meet any social referral. No social referrals shall be furnished where you and the referral live at a distance greater than the distance specified in the contract. Eventide is available nationally, so this item does not apply; you set your own distance preference in the app and can change it at any time.

  5. The provider must have an established policy to address the situation of your moving outside the area it services. This policy must be explained in your contract. Eventide serves the whole United States; if you move within it, update your location in the app. If you move outside the United States, Eventide is not offered there. Cancel your subscription in your Apple Account settings and, if you wish, delete your account; Terms §15 and the notice below say how to obtain a refund of any unused period.

  6. If any provision of the social referral service contract is violated, you have the right to bring a court action against the provider which has violated the contract. Terms of Service §14 preserves your right to bring an individual claim in small-claims court, and §15's New York rights override anything else in the Terms.

Your personal information

New York law also provides, and our Terms and Privacy Policy already do, that Eventide will not sell, assign or otherwise transfer to anyone the personal information you give us (your answers, your photographs, your background) without your prior written consent, and that when your account ends, that information is deleted. Eventide erases it within 24 hours of account deletion (Privacy Policy §8), and you can ask us for written confirmation at support@eventidedating.com.

If we ban a member for fraud

If we ban a member because, in our judgment, they were using a false identity or posed a significant risk of trying to get money from other members, we tell every New York member who received and responded to a message from them, within 24 hours of the ban and never later than three days, giving the banned member's profile identifier and the reason, a reminder never to send money or personal financial information to another member, and a link to our safety page.

YOU MAY CANCEL THIS CONTRACT, WITHOUT ANY PENALTY OR OBLIGATION, WITHIN THREE (3) BUSINESS DAYS AFTER THE DATE OF THIS CONTRACT BY MAILING THIS SIGNED AND DATED NOTICE OF CANCELLATION BY CERTIFIED OR REGISTERED UNITED STATES MAIL OR EMAIL TO THE SELLER AT THE ADDRESS OR EMAIL ADDRESS SPECIFIED HEREIN.

IF YOU CANCEL, ANY PAYMENTS MADE BY YOU UNDER THE CONTRACT WILL BE RETURNED WITHIN TEN (10) BUSINESS DAYS FOLLOWING RECEIPT BY THE SELLER OF YOUR CANCELLATION NOTICE.

How this works with Apple: your subscription is billed by Apple. Send the cancellation email above, then turn off auto-renew in your Apple Account settings so the next period does not start, and ask Apple for the refund at reportaproblem.apple.com. If Apple declines a refund this notice entitles you to, we refund you ourselves within ten business days of your notice (Terms of Service §15).
