Terms of Service — Eventide
Effective date: 2026-09-19 Last updated: 2026-10-14
YOU, THE BUYER, MAY CANCEL THIS CONTRACT, WITHOUT ANY PENALTY OR OBLIGATION, AT ANY TIME PRIOR TO MIDNIGHT OF THE THIRD BUSINESS DAY FOLLOWING THE DATE OF THIS CONTRACT, EXCLUDING SUNDAYS AND HOLIDAYS. NOTICE OF CANCELLATION NEED NOT TAKE A PARTICULAR FORM AND IS EFFECTIVE IF IT INDICATES YOUR DESIRE TO NOT BE BOUND BY THIS CONTRACT. TO CANCEL THIS CONTRACT, SEND AN E-MAIL THAT STATES THAT YOU, THE BUYER, ARE CANCELING THIS CONTRACT, OR WORDS OF SIMILAR EFFECT. SEND THIS NOTICE TO: support@eventidedating.com, the cancellation address of Eventide.
This paragraph sits first because Colorado law requires an online dating service contract to open with it. Eventide itself is free; the paragraph matters if you buy Eventide Premium, and §15 explains how it and the cancellation rights of other states work with a subscription bought through Apple.
¶1. Who we are, and what this is
Eventide ("Eventide", "we", "us") is a dating service for members and friends of the Seventh-day Adventist community, operated by Jonathan Demyan, an individual, at 4891 Taylor Circle, Collegedale, TN 37315. Eventide is offered in the United States only.
These Terms are a binding agreement between you and us. By creating an account you accept them. If you do not accept them, do not create an account. Our Community Rules at https://eventidedating.com/community restate the standards in §5 in plain language, including the standard of modesty and appropriateness we admit members against, and form part of these Terms; where they and these Terms differ, these Terms govern.
Eventide is an independent service. We are not affiliated with, endorsed by, or operated by the General Conference of Seventh-day Adventists or any of its conferences, unions, institutions or local churches. References to churches, conferences and Adventist belief describe our members and do not indicate endorsement by any organisation.
¶2. You must be 18 or older
Eventide is for adults. You must be at least 18 years old to create an account or use the service. We ask for your date of birth during signup, refuse anyone under 18, and the date of birth cannot be changed afterwards.
If we learn that an account belongs to someone under 18, we delete it immediately without notice. Anyone can report a suspected underage account from inside the app, and we handle those reports first. If Apple or anyone else tells us an account belongs to someone under 18, we treat that as a report of the same kind. Neither parental consent nor any app-store setting makes Eventide available to a minor.
¶3. Your account
- You may hold one account. It is personal to you and you may not share, transfer or sell it.
- You are responsible for what happens under your account and for keeping your credentials secure.
- Everything you tell us about yourself must be true. Photographs must be of you, recent, and not misleading. Misrepresenting your identity, age, marital status or relationship intentions is a violation of these Terms.
- You may sign in with an email address and password, or with Sign in with Apple. If you use Sign in with Apple and choose to hide your email address, we receive Apple's relay address and can reach you only through it.
¶4. How Eventide works
- Two steps before a profile goes live. Eventide is a community of real people who hope to marry, and two different steps keep it that way. The liveness check below is how we check that each new member is a real person, present when they join, and the person in their own photographs. The review is how we keep the community's standard: a person reviews every photograph and every piece of written profile content (your name, bio, prompt answers, church information, your own words about how you eat and the camps, trips and schools you list under "Been part of", when you first sign up and every time you add to or change them) against the standard of modesty and appropriateness in §5 before other members can see it. The review is about what your profile shows and says; there is no quiz or questionnaire about your faith or practice. No profile content is shown to another member without a person having approved it first. While an edit is being reviewed, your previously approved profile stays visible, so editing your profile does not hide it. If we decline something, we tell you why.
- The liveness check at signup is required to join. What Eventide provides is a community of real people, each of them present when they joined and shown truly in their own photographs. Accounts run by software, profiles built from generated or stolen photographs, and people who are not who their photographs show are what that community exists to keep out, and a profile's photographs and words cannot show that a real person made it. So everyone who signs up takes a short check with their phone's front camera, and its Face ID depth camera where it has one, which checks that a real person is in front of it and is the person in the profile photographs. The shape of your face is measured on your phone, and those measurements are biometric information. Before the camera opens, the app asks for your agreement on its own screen, separate from these Terms, and tapping Start signs it. We receive photographs from the check (and a short video on phones without the depth camera), an image of the depth reading and the measurements, which our storage provider keeps for us. Our server compares the measurements with fixed limits; a person at Eventide compares the check's photographs with your profile photographs by eye and, where the measurements cannot settle the check (three attempts that did not pass, or a phone without a depth camera), decides it from the check's own photographs and depth image or video. Everything from the check is used only for the check, never to identify you, never sold, and never shared except where the law requires it, and is deleted on the schedule in our Privacy Policy (§3.8 and §7), or sooner if you delete your account or ask us to. If you do not want to take the check, do not create an account: a profile is not sent for review, and cannot be admitted, without it, and you can delete your account at any time. A member who joined before the check existed is not asked to take it, and can choose to take it later for the Verified badge (below). Deliberately defeating the check, for example with a photograph, a screen, a mask, a recording or another person, is misrepresenting your identity under §3.
- Two things are not reviewed in advance, so that conversations are not delayed: messages between matched members, and the short comment you can attach to a like. Both are delivered immediately, both are covered by §5 in full, and both can be reported in two taps.
- Introductions. We show you a limited number of member profiles each day, chosen and ordered by us. Once you have seen them, no more are shown until the next day. Our Privacy Policy §5 describes how the ordering works.
- Matching and messaging. When two members each indicate interest, a match is created and messaging opens. You can only message people you have matched with.
- Optional AI conversation starter. Where the app offers it, after a match both members may separately choose to turn on a private exercise in which an outside AI provider asks each of them a few private questions (in this community, often about faith and practice) and then places one suggested conversation starter in their shared chat, labelled as generated by Eventide's AI. Nothing is sent to that provider unless both of you turn it on. It is never given your existing messages or photographs, or the name, age, location, church, conference or diet we hold as separate fields; anything you wrote in your bio or prompts goes as written. Our Privacy Policy §3.6 lists what is sent, to whom, and what is excluded. Private answers are never shown or quoted to the other member. The starter is, however, written from both members' answers and will reflect them, and you answer on that understanding. They are encrypted while temporarily stored and are deleted when the starter is posted or within 24 hours at the latest. The posted starter stays in your conversation like any other message. Generated text can be incomplete, awkward or wrong. It is a suggestion and is not a statement by either member, and nobody has to use it.
- Verification badges. A profile can show two badges. The Verified badge comes from the liveness check: other members see it on your profile once a person at Eventide admits your profile after a check that passed. If your profile was admitted without a passed check, you can choose to take the same check later from Profile, after agreeing to it on its own screen; if it passes, a person at Eventide compares it with your profile photographs and decides whether to give you the badge. The badge means that a person confirmed you are a real person and the person in your profile photographs, that is, the member using the account. It shows nothing from the check itself (Privacy Policy §3.8). Members verified with selfies before 2026-10-11 keep their badge. You may choose to earn the church badge: a person checks the church-affiliation details you give us. A badge means we checked that one thing. It does not confirm a person's name, age, identity or background, or guarantee their character, intentions or safety, and neither does a passed liveness check.
- Experience: events you go to. Experience lists three kinds of event: gatherings, open homes and mission trips. A gathering can be run by a host, and every open home is (see "Host accounts" below). You can mark an event you plan to attend, verify that you are going, see the other members verified for it, and, when it ends, like up to 5 of them, for 7 days. A like you send at an event is shown to the person you liked, with your note, and a match is made only if they like you back. A like cannot be taken back. Mark only events you plan to attend, and make sure any proof you give us that you are going is genuine and is yours. Using Experience to find out where someone is, or to follow them, is misusing it, and it is grounds for removing your account. Our Privacy Policy §3.9 says what Experience collects and how long we keep it.
- We list events; we do not run them. Unless a listing says Eventide runs it, every event in Experience is run by someone else: a gathering by its organiser or by a host, an open home by its hosts, a mission trip by its organiser. We choose what to list and check some things before we list it. We do not organise, run or supervise the event, and we are not responsible for what happens there. Unless a listing says otherwise, its organiser or hosts do not work with Eventide, and listing an event does not mean either of us endorses the other.
- Open homes. An open home is an evening in the home of a married couple who host a small group of members. It is run by a host with a host account, and before the open home can be created a person at Eventide compares the face check and photo ID of both spouses. That check means only that we did it. It is not a criminal background check, and it does not confirm the hosts' character, their home or anything that happens there. The hosts run their own home and their own evening, and their house rules apply. Only members who have passed the liveness check, or who joined before it existed, can save a seat. Seats are shared equally between men and women, and when your side is full you join its waitlist. Saving a seat means you agree to follow the Community Rules during the evening, in the hosts' home and on the way there and back. The hosts see your first name and photo. Keep the address we give you to yourself, and do not bring anyone who does not hold a seat.
- If you cannot come, give up your seat. Leave the event in the app before the evening starts, so the next person waiting can come. If you hold a seat and do not come, the hosts or we may mark you as a no-show. A no-show mark is not a penalty and does not stop you from saving a seat later; it is kept in your account's record (Privacy Policy §3.9). If you think we marked you by mistake, write to support@eventidedating.com and we will look at it again.
- Mission trips. A mission trip in Experience is run by its own organiser. You sign up, pay and travel with the organiser, on the organiser's terms; Eventide takes no booking and no money, is not a party to your arrangement with the organiser, and is not responsible for the trip, its cost, its safety or its refunds. Follow the organiser's rules during the trip, including any rules about relationships. Likes for a trip open only once it has ended.
- Suggesting an event. You can suggest a gathering or a mission trip, up to three a week; an open home is created by a host, not suggested. Suggest only events you believe are real, and give us someone's contact details only if they are happy for us to contact them. We decide whether to list a suggestion and may change its details before we do; if we decline it, we tell you why.
- Host accounts. A host account is used only to run events. Hosts also agree to the Host Agreement at https://eventidedating.com/host-agreement. A host account cannot be used as a member account, and the kind of account is fixed when it is created. A host sees the first name and first profile photo of each member going to their event, as the caption next to "I'm going" says, and nothing else about you (Privacy Policy §3.10).
We may change, suspend or discontinue any part of the service. Where a change materially reduces what a paid subscription provides, we will tell you before it takes effect. If we ever discontinue Eventide entirely, we will give you at least 30 days' notice and time to export what the app lets you export, and Apple's refund rules apply to any remaining paid period.
¶5. Content standards: zero tolerance for objectionable content
We have no tolerance for objectionable content or abusive behaviour on Eventide. We enforce the rules in this section.
You may not post, send or share:
- sexually explicit or pornographic material of any kind, or nudity;
- content that is hateful, harassing, threatening, bullying, defamatory or demeaning toward any person or group, including on the basis of race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability or age;
- content that sexualises minors in any way, or any content involving a person under 18;
- violent, gory or gratuitously disturbing content;
- false or impersonating content, including photographs that are not of you, another person's photographs, and any claim about your identity, age, marital status or intentions that is untrue;
- commercial content: advertising, solicitation, recruitment, multi-level marketing, or promotion of another service;
- requests for money, financial information, gift cards or cryptocurrency, or any other content of a scam or fraud;
- another person's private information, such as their address, phone number, financial details or immigration status, without their consent;
- content that infringes anyone's copyright, trademark or other rights (§11 says how to report infringement, and what happens to repeat infringers);
- anything unlawful.
Modesty and appropriateness. Beyond the list above, every profile must meet the standard of modesty and appropriateness set out in our Community Rules, which covers how you are dressed and how you present yourself in your photographs, and how you write about yourself. It is one standard, applied in the same way to every member, and it is about what a profile shows and says. By creating an account you agree that we decide who is admitted to Eventide, and that we may decline a photograph or words, or decline or remove a profile, that in our judgment does not meet that standard. We tell you what to change, and you can change it and send it again. A decision under the standard is never based on a member's sex, race, colour, ethnicity, national origin, ancestry or disability.
You also may not:
- use Eventide while married or in a committed relationship your partner has not agreed to, or otherwise misrepresent your availability;
- contact a member who has blocked you, or evade a block, suspension or ban by creating another account;
- harass, stalk, intimidate or threaten anyone, on Eventide or elsewhere as a result of meeting them here;
- scrape, copy, or redistribute other members' profiles or photographs, or use automated means to access the service;
- attempt to breach, probe or interfere with our systems or another member's account.
¶6. Reporting, and what we do about it
Every profile and every conversation carries reporting and blocking, reachable in two taps. Blocking is immediate and mutual: you and the person you blocked disappear from each other's introductions, likes, matches and profile pages, and any conversation between you is closed.
A person reviews every report. We aim to act on objectionable content and abusive users within 24 hours, by removing the content or by warning, suspending or permanently banning the account, as the case warrants. Reports about safety are handled first. Where we suspend or ban an account, we may keep a record of it, so that the person cannot return under a new one.
No account is suspended automatically because of reports. Eventide reviews every report and may warn, hide, suspend or ban the account. A warning always names the reason. A hidden profile is not shown to other members, and the member keeps their existing matches and conversations. Eventide may also remove a photograph or profile text that breaks these Terms or the Community Rules, with a note to the member saying why.
If we ban a member because, in our judgment, they were using a false identity or posed a significant risk of trying to get money from other members, we tell every member who received and responded to a message from them, wherever they live, within 24 hours of the ban and never later than three days. §15 describes what that notice contains.
If more than one member reports you, and we confirm and act on what they reported, for harassment, threats, sexual misconduct, deceiving or defrauding other members, or other conduct that puts someone's safety at risk, we may tell your pastor or a leader of the church on your profile that we acted on your account, the kind of conduct, and when. We tell you first and give you 7 days to answer, unless waiting would put someone at risk. We never tell them who reported you. Our Privacy Policy (§6) sets out exactly what is shared.
Do not file a report you know to be false, or for a malicious, biased or otherwise illegitimate reason; we treat that as a breach of these Terms, and it can lead to the same consequences as the conduct being reported.
We may remove content or suspend an account without prior notice where we believe someone is at risk of harm. We will tell you why, unless doing so would put someone at risk or is prohibited by law.
We report to law enforcement where we are required to, or where we believe there is a credible threat to someone's safety, or where content involves the sexual exploitation of a minor.
¶7. Your content, and the rights you give us
You keep ownership of everything you post, including your photographs, your words and your profile.
You give us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display and distribute that content for the purpose of operating Eventide: showing your profile to other members, delivering your messages, and reviewing content for safety and compliance with these Terms. This licence includes the right to sublicense to the service providers who host and store data for us (our Privacy Policy §6 names them), solely so they can provide those services to us. If you and a match both turn on the optional conversation-starter feature, this also permits the AI providers named in Privacy Policy §6 to process the limited profile excerpts and temporary answers described in Privacy Policy §3.6, solely to ask the questions and write that one starter, under the zero-data-retention and no-training terms described there.
This licence lasts as long as your content is on Eventide and ends when you delete it or delete your account, except that it continues for: backup copies until they are overwritten in the ordinary course, and the records we are required or permitted to retain as described in §7 and §8 of our Privacy Policy and §10 below. Our backups expire within 30 days (Privacy Policy §7).
We do not use your photographs or your words to advertise or promote Eventide outside the app without asking you first. We do not use your content to train machine-learning models. Using a language model to provide the optional feature in §4 is processing to answer that specific request. It gives no permission to train on your content, and the providers we use for it are bound not to train on it either (Privacy Policy §3.6).
You promise that you have the right to post what you post, and that it does not infringe anyone else's rights.
¶8. Safety
EVENTIDE DOES NOT CONDUCT CRIMINAL BACKGROUND SCREENINGS ON ITS MEMBERS.
We do not check identity documents, and we do no screening beyond what §4 describes: the liveness check at signup, which is how we check that a new member is a real person and the person in their photographs, the review of every profile against our standard of modesty and appropriateness, and, for hosts, a person's comparison of each host's face check with their photo ID, and our reading of each event before it is listed. We run no criminal background check on hosts either. A badge, a passed check or an approved profile means we checked something. It does not confirm who anyone is or guarantee anyone's character, intentions, marital status or safety.
You are meeting strangers, and you are solely responsible for your interactions with other members, online and offline. We are not responsible for the conduct of any member. Please read our safety page at https://eventidedating.com/safety before your first meeting. It includes the safety-awareness information several states require us to give you. Never send money or financial information to someone you met on Eventide, whatever reason they give.
¶9. Eventide Premium
Eventide is free to use: a full profile, your daily introductions, unlimited likes within them, matching and messaging cost nothing. We do not show advertisements.
Eventide Premium is an optional auto-renewing subscription, sold in one-month, three-month and six-month terms at the prices shown in the app before you confirm the purchase.
- Payment is charged to your Apple Account when you confirm the purchase.
- Renewal is automatic at the same price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged within 24 hours before the period ends.
- You manage and cancel your subscription in your Apple Account settings (Settings ▸ your name ▸ Subscriptions on your device), not here. Cancelling takes effect at the end of the period you have paid for; until then Premium features remain.
- Refunds for App Store purchases are handled by Apple, under Apple's terms, at reportaproblem.apple.com. We do not process App Store refunds and generally cannot reverse a charge Apple made. Where a statute gives you a cancellation or refund right that Apple does not honour, we will make you whole ourselves (see §15).
- Deleting your account does not cancel your subscription. Cancel it in your Apple Account settings first, or you will keep being charged.
- Prices may change. We will tell you in advance, and a price increase does not take effect on your subscription without the consent Apple requires.
If a jurisdiction gives you a statutory right to cancel a dating-service contract within a set period, or to a refund, that right applies regardless of anything in this section. §15 sets out the ones we know apply.
¶10. Ending your account
You may delete your account at any time, from inside the app: Profile ▸ settings ▸ Delete account. Deletion is immediate: your profile disappears from Eventide at once, and we erase your data as described in our Privacy Policy §8.
We may suspend or terminate your account if you breach these Terms, including the standard of modesty and appropriateness in §5, if we believe you present a risk to another member, or if we are required to. Where we can, we will tell you why.
If your account is terminated for breaching these Terms, you are not entitled to a refund of any unused subscription period, except where the law requires one, including the state rights in §15, which survive this section.
¶11. Intellectual property
Eventide's name, logo, design, software and the prompt bank are ours. These Terms give you a personal, limited, revocable, non-transferable licence to use the app as an ordinary member. You may not copy, modify, reverse-engineer, resell or create derivative works from it, except where law permits it regardless of these Terms.
We respect copyright and expect members to. Our Copyright (DMCA) Policy at https://eventidedating.com/copyright is part of these Terms: it explains how to send a takedown notice to our designated agent, how counter-notice works, and our policy of terminating repeat infringers in appropriate circumstances.
¶12. Data and privacy
How we collect, use and keep your information is set out in our Privacy Policy at https://eventidedating.com/privacy, which forms part of these Terms.
We also make three commitments here:
- Deleting your account deletes your data. Your profile, photographs, preferences, devices, sessions and the content of your messages and like comments are erased within 24 hours; copies in our nightly disaster-recovery backups expire within 30 days after that (Privacy Policy §7), and biometric information from the liveness check is never in a backup. We keep an anonymous placeholder so that other members' conversations are not altered, and we keep our record of any ban.
- We collect information about your religious affiliation (your home church and conference) because Eventide is built for that community. We also ask how you eat, because sharing meals is a practical part of dating here and members want to be able to filter for it. In this community that answer can carry religious meaning too, so we treat it as sensitive, as the Privacy Policy explains (§3.4). We ask nothing else about your belief or practice. We collect this data only with your separate consent, given on the screen where you enter it and apart from these Terms, and we never sell it. We do not sell any member data.
- Biometric information only with your separate consent, and only for one check. The only biometric information Eventide handles is the liveness check in §4, taken at signup or later from Profile for the Verified badge, which measures the shape of your face on your phone. The check is required to join, and taken later it is optional; either way it runs only after you agree to it on its own screen, apart from these Terms. It is used only for that check, never to identify you or to compare your face with anyone else's, never sold, and never shared except where the law requires it, and it is deleted on the published schedule in our Privacy Policy (§7). Other members see only the Verified badge a passed check earns, never anything the check produced. We compute no face templates or faceprints from anything you send us.
¶13. Disclaimers and limitation of liability
Eventide is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that you will find a match, that the service will be uninterrupted or error-free, or that any member is who they say they are.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising out of or relating to Eventide, including the conduct of members, online or offline, and the conduct of the hosts and organisers of events listed in Experience, or anything that happens at those events, in those homes or on those trips. Our total liability for all claims relating to Eventide is limited to the greater of the amount you paid us in the twelve months before the claim arose, or USD 100.
Some jurisdictions do not allow some of these exclusions or limits, and in those places they apply only to the extent permitted. Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for anything else that cannot be limited by law.
¶14. If we have a dispute
Talk to us first. Before either of us starts arbitration or a lawsuit, the one with the claim must send the other a written notice describing the claim and what would resolve it (to us at support@eventidedating.com, and to you at your account email), and both of us must then try in good faith to resolve it for 60 days.
Small claims. Either of us may bring an individual claim in small-claims court in your county (or our home county) instead of arbitration, and that court's decision is final as any small-claims judgment is.
Arbitration, individually. Any other dispute arising out of or relating to these Terms or Eventide is resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The AAA's consumer fee schedule applies, and we will pay the filing, administration and arbitrator fees those rules assign to us. The arbitration is held in your county by videoconference or on documents unless you and we agree otherwise, and the arbitrator can award whatever an individual court action could. Judgment on the award may be entered in any court with jurisdiction. The Federal Arbitration Act governs this section.
No class actions. You and we each waive the right to a jury trial and the right to participate in a class, collective, consolidated or representative action, in court or in arbitration. If this waiver is held unenforceable as to a particular claim, that claim proceeds in court, and the rest of this section still applies to everything else.
Your right to opt out. You may opt out of this arbitration agreement and the class waiver entirely, with no effect on anything else in these Terms, by emailing support@eventidedating.com with "Arbitration opt-out" and the email address on your account within 30 days of first creating your account (or, for existing members, within 30 days of these Terms first taking effect for you).
If many claims arrive at once. If 25 or more demands of a substantially similar nature are brought against us by the same or coordinated counsel, the AAA's rules and procedures for multiple case filings apply, and you and we will cooperate in good faith on a batching or bellwether process so the claims can be resolved efficiently; statutes of limitation are tolled while a claim waits in that process.
Carve-outs. Either of us may seek injunctive or other equitable relief in court to protect intellectual property or to stop harassment, stalking, or a threat to a person's safety, without first arbitrating.
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs §14. If the arbitration agreement does not apply to a dispute, that dispute belongs to the state or federal courts located in Hamilton County, Tennessee, and both of us consent to their jurisdiction. Nothing in this paragraph takes away a consumer protection your own state's law gives you.
¶15. State-specific rights and notices
Several states regulate dating-service contracts, and their rules differ. We apply the strongest of them to every member as our own terms, and then list what particular states additionally require. Where a state's law gives you more than this section says, the state's law applies.
For every member, in every state, as our own terms:
- Seven days to change your mind. You may cancel Eventide Premium for any reason within seven calendar days after a purchase or a renewal and receive a full refund. Email support@eventidedating.com from your account email (any words that say you are cancelling are enough), and turn off auto-renew in your Apple Account settings so the next period does not start. Ask Apple for the refund at reportaproblem.apple.com; if Apple declines a refund this paragraph entitles you to, we refund you ourselves within 10 days of your notice. Several states require three business days; seven calendar days is always at least that.
- Death or disability. If you die, or become unable to use Eventide because of a disability, before the end of a paid period, you or your estate are relieved of any further payment and we refund the unused portion. We do not ask for a physician's letter. Several states require a version of this; we apply it in every state.
- Nothing here is waived. No part of these Terms asks you to give up a right a dating-service statute gives you, and any part that did would have no effect.
- Other states. If your state gives you a right this section does not mention, we honour it. Write to support@eventidedating.com.
What particular states require us to tell you:
-
California. Under California Civil Code §1694.1 you may cancel a dating-service contract until midnight of the third business day after you enter it, by email to support@eventidedating.com, and every payment is refunded within 10 days of your notice; our seven-day term above is the same right with more time. Under §1694.3, if you die or become disabled before the end of a paid period, you or your estate are relieved of further payments and refunded the unused portion; the statute lets a seller ask for a physician's verification of a disability, and we do not.
-
New York. Under New York General Business Law §394-c you may cancel a social-referral-service contract without a cancellation fee within three business days after you receive it (for Eventide Premium, the day you buy it), and you have the rights in the Dating Service Consumer Bill of Rights, which we provide with every purchase and renewal, together with the statutory notice of cancellation, at https://eventidedating.com/ny-bill-of-rights. YOU, THE BUYER, MAY CANCEL THIS CONTRACT WITHOUT ANY CANCELLATION FEE WITHIN THREE (3) BUSINESS DAYS AFTER THE DATE OF THIS CONTRACT. SEE THE ATTACHED NOTICE OF CANCELLATION FORM FOR AN EXPLANATION OF THIS RIGHT. (The form is on the page linked above.) You may also place your membership on hold for up to one year by writing to support@eventidedating.com: we hide your profile for that time, you turn off auto-renew so you are not charged while on hold, and we refund any unused paid days at the date the hold begins. §394-c also requires this: if we ban a member because, in our judgment, they were using a false identity or posed a significant risk of trying to get money from other members, we tell every New York member who received and responded to a message from them, within 24 hours of the ban and never later than three days, giving the banned member's profile identifier and the reason for the ban, reminding you never to send money or financial information to another member, and linking to advice on avoiding fraud. New York's Internet dating safety law (§394-cc) requires us to give you safety-awareness information when you register and by a link from our first entry point; it is on our safety page at https://eventidedating.com/safety. We also tell you, as we tell everyone: EVENTIDE DOES NOT CONDUCT CRIMINAL BACKGROUND SCREENINGS ON ITS MEMBERS.

Colorado. Under Colorado Revised Statutes §6-1-731 you may cancel a dating-service contract until midnight of the third business day after you enter it, by email to support@eventidedating.com (the first paragraph of these Terms is that notice, and an email in any words that say you are cancelling is enough), and every payment is refunded within 10 days of your notice: through Apple where Apple will, and by us where it will not. If you die or become disabled before the end of a paid period, you or your estate are relieved of further payments and refunded the unused portion. If we ban a member because, in our judgment, they were using a false identity or posed a significant risk of trying to obtain money from other members, we notify every Colorado member who received and responded to a message from them within 24 hours (never later than three days), with the same content as the New York notice above. Under §6-1-731.5, our safety policy is our safety page at https://eventidedating.com/safety: it describes what we prohibit, what we do and do not check, when we suspend or ban, how to report, how to appeal, and where to find help in Colorado.

Arizona. Under Arizona Revised Statutes §44-7153 you may rescind a dating-referral-services contract within three business days after you enter it by sending a signed written notice by certified mail to the address in §19, or by delivering it there; we also accept the email route in our seven-day term above, which gives you more time and an easier method. Every payment is refunded within 30 days of your notice under the statute, and within 10 days under our own term. No Eventide Premium term is longer than six months (§44-7154 limits an initial term to one year), and nothing in these Terms asks you to give up any right against us (§44-7154(A)(3)).

Illinois. Under the Dating Referral Services Act (815 ILCS 615, §20) a customer who does not purchase at a physical facility (which includes everyone who buys Eventide Premium) may cancel within seven calendar days and receive a full refund, which is the same seven days as our own term above; and if you die before the end of a paid period your estate is refunded the unused portion (our own term adds disability). Illinois' Internet Dating, Internet Child Care, Internet Senior Care, and Internet Home Care Safety Act (815 ILCS 518, §§10(b) and 15) makes it unlawful for us not to tell Illinois members whether we perform criminal background screenings: EVENTIDE DOES NOT CONDUCT CRIMINAL BACKGROUND SCREENINGS ON ITS MEMBERS. Safety-awareness information is on our safety page.

The notice must be provided to the club before midnight of the third business day after you sign this contract. If you cancel, the club will return, within ten days of the date on which you give notice of cancellation, any payments you have made.
MEMBERS' RIGHT TO UNILATERAL TERMINATION
You may unilaterally terminate this contract in your exclusive discretion at any time. If you terminate, your membership will terminate at the end of the membership term in which you provided the club with notice of termination. ¶16. Apple
Because you received Eventide through Apple's App Store, Apple requires us to state the following:
- These Terms are an agreement between you and us, not with Apple, and we, and not Apple, are solely responsible for Eventide and its content.
- Your licence to use the app (§11) is limited to a non-transferable licence to use it on Apple-branded products that you own or control, as permitted by the Usage Rules in Apple's App Store terms, except that the app may be accessed by other accounts via Family Sharing.
- Apple has no obligation whatsoever to furnish any maintenance or support for the app; we are solely responsible for it (§19 has our contact details).
- If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price of the app to you; to the maximum extent permitted by law Apple has no other warranty obligation with respect to the app, and any other warranty claim is our responsibility as between us and Apple.
- We, not Apple, are responsible for addressing any claim by you or a third party relating to the app or your possession and use of it, including product liability claims, claims that it fails to conform to a legal or regulatory requirement, and consumer-protection or similar claims.
- In the event of a third-party claim that the app or your possession and use of it infringes that third party's intellectual property rights, we, and not Apple, are solely responsible for its investigation, defence, settlement and discharge.
- You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with applicable third-party terms of agreement when using the app (for example, your wireless data agreement).
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
¶17. Indemnity
If someone brings a claim against us because of what you did on Eventide (content you posted, your conduct toward another member or toward the hosts or organiser of an event you went to through Experience, or your breach of these Terms or of the law), you agree to indemnify us, which means covering the losses, and the reasonable legal costs, that claim causes us. We will tell you promptly about any such claim and will not settle it in your name without your agreement. This section does not apply to the extent a claim arises from our own breach of these Terms or our own unlawful conduct, and it does not apply where the law does not allow it.
¶18. General provisions
- Severability. If any part of these Terms is held unenforceable, the rest stays in force, and the unenforceable part is replaced by the enforceable term closest to its intent, except as §14 provides for the class waiver.
- Entire agreement. These Terms, with the documents they incorporate (Community Rules, Privacy Policy, DMCA Policy), are the entire agreement between you and us about Eventide, and they supersede any earlier ones.
- No waiver. If we do not enforce a provision, we have not given it up; we can enforce it later.
- Assignment. You may not assign these Terms or your account. We may assign these Terms as part of a merger, acquisition or sale of the service. If we do, Privacy Policy §6 governs what happens to your data and you will be told first.
- Notices, electronically. You agree that we may give you notices, including legal notices, in the app or by email to your account address, and that those count as "in writing". Keep your email reachable; Sign in with Apple's relay address counts, as long as you do not disable it. Notices to us go to support@eventidedating.com or the postal address in §19.
- Survival. The sections that by their nature outlast your account (§7's retained-records tail, §10, §12–§15, §17 and this section) survive its deletion or termination.
- Force majeure. We are not responsible for delay or failure caused by events beyond our reasonable control.
¶19. Changes, and how to reach us
We may update these Terms. If a change is material we will tell you in the app or by email before it takes effect, and continuing to use Eventide after that date means you accept the change. A material change to §14 (disputes), however, restarts your 30-day opt-out window. The "Last updated" date at the top always reflects the current version.
